3. These terms apply to users who use an account, purchase access to ports and use the application during sightseeing.

§ 2. Nature of the service

1. BSS PORT WALK is a digital service that supports independent planning and completion of walking tours during a cruise ship's port call.

2. Depending on the port, the application may provide, among other things, a map, sightseeing points, a recommended order, approximate times, information about attractions, voice guidance, a return plan and features for offline use.

3. BSS PORT WALK is not an official navigation system of a cruise line, port, city, public authority or transport operator.

§ 3. User account

1. A user account is generally required to purchase and assign ports, unless the operator offers another form of use in the future.

2. The user agrees to provide correct information and protect their access credentials against access by third parties.

3. The account is used, among other things, to store information about purchased ports, access to updates and the ability to download available packages again.

4. The account must not be shared in a way that results in unauthorised distribution of paid content or circumvention of licence terms.

§ 4. Selection and purchase of ports

1. The user may select one or more ports available in the catalogue. The price and scope of the relevant package will be displayed before the order is placed.

2. Before payment, the user receives an order summary containing at least the selected ports and the total price.

3. After successful payment, the purchased ports are assigned to the user account and can be prepared for use in the application.

4. Payment methods, currency, taxes and possible discounts are specified directly during the checkout process.

§ 5. Offline packages

1. BSS PORT WALK is designed to allow prepared walking-tour features to be used even with limited or no internet connection.

2. Before leaving the ship, the user should download the required port packages, check them and make sure the application marks them as ready for offline use.

3. Some external data, especially information retrieved continuously from internet services, may not be available in offline mode.

4. The operator may provide package updates containing corrections to routes, points, voice guidance or other data.

§ 6. Technical requirements

1. Registration, sign-in, purchases, downloading packages and updates require a device with a supported browser and internet access.

2. Navigation features may require an active GPS location service and the user's permission to access the device location.

3. Location accuracy depends on the device, surroundings, buildings, weather, satellite availability and system settings.

4. Before starting sightseeing, the user should check the battery level, availability of downloaded data and operation of location services.

§ 7. Navigation and safety

1. Pedestrian navigation, walking times, suggested routes and voice guidance are provided for assistance only.

2. The actual situation on site, signs, traffic lights, instructions from competent authorities and local traffic rules take precedence.

3. The user must not follow an instruction from the application if it would lead onto closed premises, unlawfully onto a roadway, onto a dangerous route, or otherwise contrary to signs or regulations.

4. Information about the remaining return time is indicative. The user is responsible for allowing an appropriate safety margin and returning to the ship on time.

5. BSS PORT WALK does not guarantee that a ship will wait for a user who returns late.

§ 8. Licence and permitted use

1. Purchasing a port grants the user a non-exclusive, personal licence to use the supplied package for its intended purpose.

2. Without the operator's consent, resale, mass copying, public distribution, circumvention of protection measures and use of content to build a competing database or service are prohibited.

3. Rights to external maps, data and other materials belong to their respective rights holders and are used under the relevant licences.

§ 9. Updates and availability

1. The operator may update the application and port packages to improve functionality, security, technical compatibility and the currency of data.

2. Before starting a trip, the user should check whether updates are available.

3. Temporary technical interruptions may result from maintenance, updates or failures of external services.

4. Updates required under applicable rules for digital products will be provided to the extent and for the period resulting from the contract and applicable law.

§ 10. Complaints

1. Complaints concerning the operation of the digital service may be sent to support@bss-studio.com.

2. Where possible, the report should include the account email address, the port name, a description of the problem, device and browser information, and whether the problem occurred online or offline.

3. Consumer rights relating to a digital product's lack of conformity with the contract remain unaffected.

§ 11. Right of withdrawal

1. Consumers have a right of withdrawal to the extent provided by mandatory legal provisions.

2. If the user requests that the supply of digital content begin before the withdrawal period expires, the right of withdrawal may cease only if the legally required conditions are met, in particular the user's prior express consent and acknowledgement that they understand the consequences of giving that consent.

3. Required consents and notices will be displayed during the payment process where they are necessary for the relevant purchase.

§ 12. Liability

1. The operator endeavours to provide useful and up-to-date information about points, routes and times; however, local conditions may change independently of the application.

2. Limitations of liability in these terms do not affect mandatory consumer rights or any liability that may not be excluded or limited by law.

3. The user should exercise ordinary care in public spaces and should not use the screen in a way that impairs attention in situations where the surroundings must be observed.

§ 13. Changes to the Terms

1. The operator may amend these terms for important reasons, in particular due to changes in features, payment methods, technical requirements, legal provisions or security requirements.

2. Changes affecting existing users will be communicated in a manner that takes account of the nature of the change and applicable legal requirements.

§ 14. Final provisions

1. Where these terms do not regulate a matter, the relevant mandatory legal provisions apply.

2. A choice of law does not deprive a consumer of the protection of provisions that cannot be derogated from by agreement and that would apply in the country of the consumer's habitual residence.

3. The current version of the Terms of Use is available at portwalk.byshipseas.com/it/terms/.
